Your contract with us

These General Conditions of Sale (GCS) apply to any services, orders and dispatches of goods that you as the client order to Sweetzerland, the seller, on its website, www.sweetzerland.net. In placing an order, you acknowledge that you have read, understood and accepted these GCS without reservation. Sweetzerland reserves the right to amend these GCS at any time by publishing a new version on the website. The placing of any order after the publication of the new version of the GCS shall be construed as acceptance thereof. In using the website www.sweetzerland.net, you further accept that you will be subject to our website Terms of Use Please read these carefully.

Registration and your account

If you open a client account with us, you are responsible for ensuring that the personal data you provided is true, accurate and current before placing an order. Please ensure that the password chosen when signing up remains confidential and is not disclosed to anyone. You can object at any time to receiving marketing messages by sending an email to chocolats@sweetzerland.net or by writing to Sweetzerland, located rue du Mont-Blanc 5, 1201 Geneva, Switzerland or by clicking the “unsubscribe” button on the message. We reserve the right to refuse service and/or terminate accounts without prior notice if you violate these Terms or if we decide that it would be in Sweetzerland’s best interests to do so.

Orders and availability

A contract shall only be concluded between you as the client and Sweetzerland upon the submission of your order and its acceptance by us. Your order may be placed on our Site using the order form (called the “bag”). It shall be subject to the prices and information posted on the Site on the day of the order. We shall inform you by email in the event that any product should become unavailable after your order has been placed. Sweetzerland reserves the right to refuse any order if:

  • the value exceeds CHF 2,000.00;
  • payment is declined by the bank;
  • the order is deemed to be fraudulent.

The photographs, diagrams, drawings or videos illustrating the products are not contractually binding.

Delivery and time limits

Deliveries are made in following countries: Switzerland, Germany, Austria, Belgium, France, Italy, Luxemburg, Monte Carlo, Netherlands, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Iceland, Ireland, Latvia, Lithuania, Malta, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Spain, Sweden, UK, USA, Canada. Your order shall be delivered to the delivery address that you indicated us. Liability for the goods shall pass to you at the time they are received by the shipping agent. Delivery is usually operated by express courier. Delivery time to Switzerland is approx. 2-3 working days. Delivery time to Europe is approx. 3-4 working days. Delivery time to other countries is approx. 4-5 working days. If an order is received on a Saturday, Sunday or public holiday, it will be treated on the next working day (Monday to Friday). It is recommended to place your orders as early as possible. Longer delivery times should be expected for orders placed before public holidays. In periods of high temperatures, we can add cooling elements to the shipment. Moreover, Sweetzerland reserves the right to refuse or postpone delivery, for example during extremely hot summer months. In case of a refusal or the differing of delivery, we will contact you within an adequate period of time.

Force majeure

Sweetzerland e-boutique shall not be held liable for delays caused by events beyond its control, for example force majeure, traffic congestion, severe weather conditions or the holding of the goods by customs authorities, and such events shall not entitle the customer to withdraw from the purchase contract or claim compensation.

Liability

In the event of any breakage, delivery error or defective products you must submit a written claim to Sweetzerland within 24 hours of receipt or without delay after the defect has been noticed through our Customer Service (chocolats@sweetzerland.net) or telephone numbers mentioned on the Site. Otherwise the delivery shall be deemed accepted.  Sweetzerland reserves the right to request a photo of the order that you consider to be defective or any other evidence. We shall take the necessary steps to replace defective products or to reimburse you in the form of a credit note within 30 days of the complaint and proof of defect. We shall not be held liable for damage during transit or damage caused by improper storage after the goods were handed over the transporting agency, you (the client) or your auxiliaries.

Price and taxes

The prices are quoted in Swiss francs (CHF) or in Euros (EUR) and apply for the products offered shown on the date on which you place the order. The indicated price for products delivered in Switzerland includes Swiss VAT by default. Prices are quoted without local VAT when the country stated as destination for the order is not Switzerland.

Delivery costs of the ordered articles are charged to you and consist of postage and packaging costs. They are calculated individually based on destination and weight. Delivery costs are shown prior to completion of the order.

For deliveries outside Switzerland, taxes and custom duties may apply and are to be paid by the receiver. The customs authorities of the country of delivery are entitled to check the shipments and levy duty and VAT (local rates) where applicable. Please contact your customs directorate or import authority for more information on the applicable regulations and duties on goods.

Payment terms

Payment takes place in advance and can be made by credit card or PayPal. If payment is made by credit card, the customer’s account will be charged immediately. The customer may not offset against payments counterclaims which are not recognized or legally established. Data protection

Your personal data shall be collected exclusively in accordance with legal requirements and shall be processed in line with our Privacy Notice.

Validity of the general conditions of sale

Should any of these GCS be declared void or partially invalid, this shall not affect the validity and scope of the remaining clauses. The invalid terms shall be replaced by legally applicable provisions of Swiss law, including any matter not regulated under these GCS.

Disclaimer

Without prejudice to the scope of these GCS, no claim whatsoever relating to products delivered or the failure to deliver products or any other claim may exceed the purchase price of the goods that gave rise to a damage claim. Sweetzerland may not under any circumstances be held liable for any indirect, incidental or consequential losses of any type whatsoever arising in relation to its products, their usage, their sale or this Site. Products must be protected against excessive humidity, excessively high temperatures or excessively intense glare. Our products are fresh products, which means that they must be consumed within a certain amount of time. For more information, refer to the expiry date indicated on the packaging of our products. Allergies: Some of our products contain peanuts, lactose and other ingredients that are prone to allergies or intolerances. You are responsible for ensuring that the products you order and consume do not contain foods of which you are allergic or intolerant to. We may not exclude that some products that do not contain allergens such as peanuts have come into contact with products that contain them. In case of allergy and as a precautionary measure, we advise you not to consume our products.

Applicable laws

Sweetzerland is delighted when you share, through feedback, your experience with our products and services. We reserve the right to adapt your testimonials for reasons of length, spelling, etc., and to publish them in emails and other communications for marketing purposes or to delete them at any time. Do not post inappropriate or offensive content on our Sites as our moderators will have to delete it. Similarly, do not use the Sites to post unwanted messages or to promote your business.
